MEMORANDUM OF SETTLEMENT BETWEEN M/S. JAFFER BROTHERS (PRIVATE) LIMITED AND M/S JAFFER BROTHERS (PRIVATE) LIMITED EMPLOYEES UNION - 2011

SHORT RECITAL OF THE CASE

The Jaffer Brothers Ltd. Employees Union, being the Collective Bargaining Agent, on expiry of the Collective Bargaining Settlement on 30th June, 2011 issued a notice under Section 42(1) of the Industrial Relations (Revival and Amendment) Act, 2010 along with memorandum of demands on 15th June, 2011. A number of meetings were held between the representatives of the Union and the Management with the co-operation of both the parties and the period of notice u/s 42(1) of The Industrial Relations (Revival and Amendment) Act, 2010 was extended from time to time up to 15th September, 2011. Finally, both the parties have agreed on the following.

TERMS OF AGREEMENT

1.

Pay Scale will be revised w.e.f. 1st July, 2012.

2.

In full and final settlement of the Charter of Demands 42(1) of The Industrial Relations (Revival and Amendment) Act, 2010 submitted on 15th June, 2011, it is mutually agreed that the Management will pay to all workers a consolidated sum of Rs. 175/- per month (Rupees One Hundred Seventy Five per month) in their salaries w.e.f. 1st July, in settlement of their Charter of Demands. This amount of Rs. 175/- per month will be added to the existing Salaries and Wages already defined in the Payroll/Salary Scale of the workmen.

The Management has agreed to increase the loan fund amount from Rs. 85,000/- per month to Rs. 95,000/- per month. The Employees loan entitlement loan entitlement will increase from 3 basic salaries or 10,000/- to 4 basic salaries or Rs. 15,000/- whichever is less subject to a minimum loan amount of Rs. 3,000/-. Repayment of the loan would continue to be made in 12 equal monthly installments.

The management has agreed to increase the conveyance allowance and washing allowance from Rs. 160/- and Rs. 50/- to Rs. 240/- and Rs. 75/- respectively.

5.

The management will discuss with Health insurance company to further improve their services to facilities the employees while remaining within the policy guidance.

6.

Union will remind HR five months before the due date of uniform entitlement, Admin HR will make sure that the uniform will be provided to staff within time.

7.

The management has agreed to pay the overtime within 3 weeks of receiving the approved overtime from Conveyance and Meal paid to unionized staff for performing continuous overtime of 5 hours in any day will be increased from Rs. 60/- to Rs. 75/- per day.

8.

It has been agreed by both the parties that in addition to this settlement, other facilities, amenities, privileges, etc. which are in terms of settlements, usage, custom and practice shall not be altered and will remain the same and will not be discontinued.

9.

The Union undertakes that during the operative period of this settlement it shall not raise any financial demands or demands having any financial implications directly or indirectly on the Management. All demands contained in the Charter of Demands dated 15th June, 2011 shall be treated as settled, disposed off or withdrawn.

10.

This settlement shall come into force w.e.f. 01st July, 2011 and shall remain in force up to 31st December, 2013. It is also mutually agreed that the revised and increased benefits as per this agreement and the relevant arrears shall only be paid to those regular workmen who are appearing on company rolls as on 30th June, 2011 and thereafter.

11.

During operative period of this settlement any increase announced by the Government through gazette notification will be given without any adjustment.
