MEMORANDUM OF AGREEMENT BETWEEN NIMIR CHEMICALS PAKISTAN LIMITED AND SHAHEEN WORKERS UNION NIMIR CHEMICALS PAKISTAN LIMITED - 2013
UNDER SECTION 2 (XXVI) AND SECTION 25 (2)
OF THE INDUSTRIAL RELATIONS ORDINANCE, 2002
This Agreement is entered on this 8th day of March, 2014, by and between:
1. NIMIR CHEMICALS PAKISTAN LIMITED, a public limited Company having it, registered office situated at Office No. 1,7th Floor, Shaheen Complex, Egerton Road, LAHORE (the “Company”) – Party of the first Part
AND
2. SHAHEEN WORKERS UNION NIMIR CHEMICALS PAKISTAN LIMITED, COLLECTIVE BARGAINING AGENT (“ CBA Union”) – Party of the Second Part.
WHEREAS the CBA Union (Party of the Second Party) Served a Charter of Demands under the provisions of Industrial Relations’ Ordinance, 2002, to the Party No 1, vide their letter Reference No. SWU/2C13/Oct dated 10/12/2013 ( The “Charter”).
AND WHEREAS the Company started bilateral negotiations with the CBA Union (Party of the Second Party) and for this purpose various meetings were held between the parties After bilateral negotiations following has been agreed to:
Note:This agreement is in full and final settlement of all the demands raised by the union in the Charter of Demand dated 10/12/2013.
1. Annual Increment
The annual increment will be subject to performance evaluation by the Company
2. 10-C Bonus
The legal bonus will be paid according to the law prevailing in the country.
3. Hajj Assistance
As per Company Hajj Policy which is going to be implemented this year.
4. Service Awards
Service awards have been fixed as follows.
a) Rs. 5,000/ - on completion of 5 years service.
b) Rs. 10,000/ - on completion of 10 years service.
c) Rs. 15,000/ - on completion of 15 years service
5. Children Education
Agreed that, with effect from 1st October, 2013, reimbursement of the school fee of children of workers upto Rs. 700/- per month per child shall be allowed to maximum of 2 (two, children. Such reimbursement will be subject to submission of original school fee bill duly attested by the principal / headmaster / headmistress of the school.
6. Group Life Insurance
The Company has already arranged life insurance coverage to all its employees as per law
7. Overtime for Festival Holiday
The overtime for festival holidays will be paid according to the prevailing in the country.
8. Call Money Allowance
The Company has agreed to increase call money allowance to Rs. 250/- to the worker who will be called to attend an emergent work at the plant.
9. Hospitalization Cover
Hospitalization cover for all the employees including their spouse and depending children will be available according to the health insurance policy of the insurance company
10. Shift Allowance
The Company has agreed to increase the Shift Allowance from Rs. 500, - to Rs. 600/- with effect from 1st February, 2014.
11. Canteen Subsidy
The Company will bear 75% of actual cost.
12. Refreshment for Night Shifts
The Company will provide three (3) standard 125 gm packs of biscuits to the workers in the night shift.
13. Milk
The Company will provide 3 liters milk to every shift.
14. Overtime
Prevailing Law of the land shall be followed in this respect.
15. Dearness Allowance
Agreed that, with effect from 1st October, 2013 an amount of Rs. 400/= (rupees four hundred only) per month, being Dearness Allowance shall be granted to every Company worker
16. Miscellaneous Allowance
Monthly miscellaneous allowance of Rs. 300/- (rupees three hundred only) shall be paid to Company workers with effect from 1st October, 2013.
17.Death Aid
The Company has agreed to increase death aid to Rs. 8,000/= (Rupees eight thousand only) shall be provided to the worker for meeting the expenses regarding the death of any of his parent whereas an amount of Rs. 15,000/= (Rupees Fifteen thousand only) shall be granted to the family of worker in case of worker’s own death.
18. Late Arrival Shift Van
Agreed that, if shift van reaches after one hour of schedule time, then overtime will be paid to those company workers who are on duty at Factory in respective shift.
19. General
I) Provisions of this agreement supersede all the earlier written or verbal agreement/notifications/instructions/understanding.
II) In case any litigation is initiated by the unionized worker of the company, the CBA will not be a party thereof.
III) That the CBA union undertakes that during the currency of the present settlement/ agreement the union shall not raise any demands whether financial or otherwise and the union will endeavor to maintain industrial peace and cooperate in increasing the production.
20. Entitlement
The facilities mentioned in this Charter of Demand are purely for Company Permanent qworkers as per list attached as Annex. “A”
Duration
It has further been settled that this agreement shall be effective and applicable from 1st October, 2013 and shall remain in force for a period of two (2) years from the said date and shall continue to be binding on both parties after the expiry of two (2) years until the expiry of two months from the date from which either party informs the other party in writing of its intention not to be bound by the settlement.
IN WITNESS WHEREOF THE PARTIES HAVE SIGNED THIS AGREEMENT ON THE DATE MENTIONED BELOW WHICH SHALL TAKE EFFECT FROM MARCH 08, 2014.
