MEMORANDUM OF SETTLEMENT BETWEEN WORKERS COMMITTEE OF KABUYE SUGAR WORKS Ltd AND MANAGEMENT OF KABUYE SUGAR WORKS Ltd

SUGAR WORKS Ltd REPRESENTING ITS MEMBERS AND MANAGEMENT OF KABUYE SUGAR WORKS Ltd REPRESENTED BY ITS GENERAL MANAGER AND ADMINISTRATIVE MANAGER. SIGNED TODAY ON 23th JUNE 2014.

PREAMBLE

Workers Committee of Kabuye Sugar Works Ltd raised few issues relating to Salary increase, Food subsidy increase and the medical insurance to be extended to the whole family members. The previous memorandum of settlement signed on 4th August 2011 is valid up to 30the June 2014. The issues raised by the Committee in their Letters dated 7/2/2014; 20/02/2014, were discussed by both parties in the meetings of 13/02/2014 &13/03/2014 and finally concluded in the meeting held on 23/06/2014. Details of the issues agreed to are as under:

1.

Both management and workers committee have agreed that there is lot of scope for improving the productivity of the factory and committed to work for the same by adopting reducing waste, cost reduction, merging the jobs and multi skilling.

2.

Management has agreed to increase the salaries of all staff and workers by 21 % with effect from 01-07-2014. Increase applies to basic pay and special allowances.

3.

It is agreed by both parties that the annual increment period is changed to 1st July of every year instead of 1st May from 2014 onwards. Annual increment of 4% will be given to eligible employee for year 2013-2014.

4.

Effective 1st July 2015 increments will be granted based on an appraisal system. The management decision in this regard is final.

5.

It is agreed to increase food subsidy as follows:

o From 1st July 2014 : 500/Rwf per day for the days present,

o From 1st July 2015 : 550/Rwf per day for the days present,

o From 1st July 2016 : 600/Rwf per day for the days present.

The agreement now signed is in full and final settlement of all the demands raised and discussed. Any other issue that is not specifically settled in this settlement, workers will have their rights as per Labour Code. Settlement is valid for a period of three years with effect from 01.07.2014 and is applicable for all the regular staff and workers on the payrolls of factory as on 01/07/2014. Any increases by law / due to change of Labour Laws or announced by the Government of Rwanda for private sector in future will be covered.
